Terms
These terms cover buying and using Chromatica and Chromatica Film, and using chromatica.store. Buying a licence means you accept them.
Who you are buying from
Chromatica is made and sold by Cutsense Mateusz Jazowski, Beskidzka 25, 44-200 Rybnik, Poland. NIP 6423191192, REGON 362188813. Contact: mj@cutsense.com.
What you buy
A licence to use the software, not the software itself. It is a one-time purchase with no subscription and no expiry date: what you buy keeps working on the version you bought, whether or not you ever buy anything from us again.
One licence covers two machines at a time, in every host it supports. Machines are yours to move: releasing a seat in your account frees it immediately for another computer. The licence is for you or your company. One licence is not a way to equip a room of freelancers who each work on their own jobs.
Activation
The licence lives on the email address you bought with. Chromatica Hub signs in with that account and activates the machine; the plugins in Premiere Pro, After Effects, Final Cut Pro and DaVinci Resolve read the licence from there. Activation records a hashed machine fingerprint, never your hardware identifiers.
Keep the account to yourself. Sharing the login is the one thing that reliably ends a licence, because it is indistinguishable from reselling it.
What you may do with it
Everything you would expect: commercial work, client work, broadcast, cinema, advertising, in any quantity, anywhere, with no royalty and no reporting. We claim nothing in what you make. Your footage never reaches us: the plugins process on your machine and send us no images, ever.
What you may not do
Resell, rent, sublicense or give away the licence or the software. Share your account. Redistribute the plugins, the engine, the LUTs or the calibration data, on their own or inside anything else. Extract the colour data and ship it as your own LUTs or presets. That data is the product. Work around activation or the seat limit.
Do not decompile or reverse-engineer the software, except where the law says you may anyway (in the EU, interoperability under the software directive). Ask us first, because we may simply tell you what you need to know.
Updates, and hosts that move
Updates to the version you bought are included and free, including fixes and new camera support as we calibrate it. A future major version may be a paid upgrade; if it is, we will say so plainly rather than switch it on quietly.
Adobe, Apple and Blackmagic change their hosts and their plugin APIs on their own schedule, and an update on their side can break a plugin overnight. We fix what we reasonably can. We cannot promise a host will keep supporting the plugin forever, and if support for a host ends, we will say which version was the last one that worked.
Prices, VAT, invoices
Prices on the site are net. VAT is added at checkout according to who you are and where you are: Polish buyers and consumers in the EU pay Polish VAT; a business in the EU or Norway with a tax number we can confirm in the official register pays net and accounts for the tax itself; outside the EU no VAT is charged. Every purchase gets an invoice by email. Invoices to companies also go to KSeF, as Polish law requires.
Payment is handled by Stripe. We never see or store your card.
Withdrawal, and how it ends
If you are a consumer you have fourteen days to withdraw from a distance purchase without giving a reason. The fourteen days run from the day the contract is made, which for a download is the day you pay. To withdraw, write to mj@cutsense.com and say so. Nothing formal is needed, though you may use the wording below. We refund within fourteen days of hearing from you, to the same payment method, and we do not charge you for the refund.
This right ends when the download has been supplied to you after you asked for it. At checkout you tick two separate boxes: one accepting these terms, and one asking for the download to be made available immediately and acknowledging that this ends the fourteen days once it is supplied. Both are asked before you pay, and we repeat them in the email that confirms your purchase. Tick neither and the sale does not start. If you would rather keep the fourteen days, do not tick the second box and write to us instead: we will hold the licence and release it when the period is over.
Model statement, if you want one: I hereby give notice that I withdraw from my contract for the purchase of the following software: [product], ordered on [date], [name], [address], [date].
Refunds beyond that
Beyond that: if the plugin will not run on a host and machine we say it supports, and we cannot get it working with you, write to us within fourteen days of buying and we refund in full. We would rather do that than have somebody stuck with software that does not run.
Support
By email, from the person who wrote the software. We answer in days, not minutes, and we will tell you when something is going to take longer or is not fixable.
What we do not promise
The software is a colour pipeline, not a guarantee about your grade. We do not warrant that it fits a particular workflow, matches any given camera to a tolerance you have in mind, or runs without interruption on every configuration in existence. Consumers keep every statutory right they have under Polish and EU law; nothing here reduces those.
For business buyers, our liability is limited to what you paid for the licence, and we are not liable for lost work, lost profit or lost time. Keep your projects backed up and your deliveries checked. That is true of every tool in the chain, including ours.
Ending the licence
You can stop using the software whenever you like. We can end a licence if it is being resold, shared, redistributed, or if activation is being worked around, and we will say why. If we ever end a licence for any other reason, you get a refund proportionate to what you paid.
Law
Polish law applies. If you are a consumer, you keep the protections of the country you live in and can bring a case there. The EU also runs an online dispute platform at ec.europa.eu/consumers/odr, though writing to us first is usually faster.
Changes
These terms can change for future purchases. The terms you bought under stay the terms for that licence; we do not rewrite them behind you.
